Geographical limitations

For compensation and criminal cases the insurance applies if the place of jurisdiction is in Europe and the Mediterranean countries. For work contract, consumer and contract law, the EU/EEA coverage applies.
In all other insurance cases, the court of jurisdiction must lie in Switzerland or Liechtenstein.

Waiting period

Conflicts involving property and neighbouring law as well as legal advice are liable to a three-month qualifying period.

Exclusions

Legal proceedings concerning ...

  • Labour law if the policy holder is an employer, board member or is entitled to stocks or profits.

  • Ownership law (disputes concerning land registry or property boundaries)

  • Patient law

  • Criminal proceedings for deliberate offences (except for acquittals or cases of self-defence or an emergency )

  • Conflicts in connection with motor vehicles: covered by motor vehicle traffic legal protection

  • Debt collection and bankruptcy law

  • Inheritance law (only right to legal consultation)

  • Disputes in the capacity as a landlord

  • Conflicts with roommates or live-in partners

  • Conflicts involving sporting activities for remuneration

Choice of legal representative

The insurance holder may demand bringing in an external lawyer and select him/her freely with the approval of Assista, given bringing in a lawyer is necessary.

Procedures in case of futility or differences in opinion

Arbitration proceedings are possible. The regulations of the Swiss Code of Civil Procedure apply.

Notice of cancellation

Notice of termination must be handed in 6 months prior to expiry of contract.

Contract term

According to contract duration as stated in insurance policy (only annual contracts with automatic renewal).

Action in case of a claim

Groupe Mutuel has to be notified as soon as possible. Groupe Mutuel will carry out a pre-audit and pass the case to the legal protection insurer, TCS. Further legal steps or the bringing in of a lawyer must be taken in consultation with the insurance company.

Specially

If the collective agreement between Groupe Mutuel and the insurer is cancelled and Groupe Mutuel does not conclude a new contract, the coverage expires for all claims that occur after the ending of the contract.

In the cases of damage compensation and criminal proceedings, the insurance applies if place of jurisdiction lies in Europe and the Mediterranean countries. In all other cases, the place of jurisdiction must lie in Switzerland or Liechtenstein.

For contractual disputes, a waiting period of 3 months applies.

  • disputes concerning contracts concluded commercially by the policy holder

  • active participation in competitions and races

  • criminal proceedings for deliberate offences (except for acquittals or cases of self-defence or an emergency )

  • conflicts with roommates or live-in partners

  • disputes with international and supranational authorities
