Geographical limitations

Depending on the insured area, the coverage applies

  • worldwide (up to at most CHF 50,000), for legal disputes concerning compensation for damages, criminal and administrative penalty law,

  • in Europe for consumer rights and other contracts,

  • or only with place of jurisdiction in Switzerland or Liechtenstein. This concerns disputes concerning insurance and contract matters as well as legal advice.

Waiting period

Insurance cover commences on the day after the premium is paid. There is a qualifying period of 3 months for contractual disputes unless the holder had a previous insurance covering the same risk right up to the inception of the new policy.

Exclusions

Legal proceedings concerning ...

  • Labour laws if the insurance holder is an employer.

  • Ownership rights

  • Criminal proceedings for deliberate offences (except for cases involving the closing of proceeding and abatements of action)

  • Conflicts involving motor vehicles

  • Patent and copyright laws

  • Prosecution and bankruptcy laws

  • Inheritance laws (legal advice only)

  • Matters involving alimony payments

  • Conflicts with live-in partners or roommates

  • Conflicts involving the remunerated execution of sports

Choice of legal representative

The insurance holder may demand bringing in an external lawyer and select him/her freely with the approval of Assista, given bringing in a lawyer is necessary.

Procedures in case of futility or differences in opinion

Arbitration prodeedings may be initiated within 90 days. Decisions made by the concordat concerning arbitral jurisdiction apply.

Notice of cancellation

Notice of termination at least 3 months before annual due-date.

Contract term

According to contract duration as stated in insurance policy (minimum contract duration is 1 year with automatic annual renewal).

Action in case of a claim

The insurance provider, Basler's or TCS' responsible branch office must be notified as soon as possible. Further legal steps or the bringing in of a lawyer must be made in consultation with the insurance company.

Optionally to private legal protection, legal protection for buildings can be taken out
