A dispute can quickly lead to a clash of interests on the part of the insurance’s lawyer. It is therefore worthwhile to pick a legal protection insurance that allows the largest possible freedom of choice of a lawyer. If bringing in an external lawyer is necessary concerning legal proceedings, some insurance companies reserve the right to refuse the suggested lawyer or to choose one of three suggested lawyers. However, the validity of such clauses is controversial: the Insurance Supervision Law allows for free choice of lawyer for legal proceedings that are under the monopoly of lawyers.
When the lawyer has been chosen, the legal protection insurance generally administers the assigned lawyer with a cost approval and directly pays his/her bill in the case of a dispute.
