Scope: advanti AG, with its registered office at Birmensdorferstrasse 108, 8003 Zurich (hereinafter referred to as "advanti"), offers intermediary services in the areas of moving services, craftsmen services and brokerage services as well as property valuations (collectively referred to as "services"). As a sister company of comparis.ch AG, advanti offers these services via the online platform(s) of comparis.ch AG ("online platform"). The services shall be provided exclusively by advanti.
These Terms and Conditions of Use apply to the private and commercial use of these services by interested parties. The following provisions contain detailed rules on the use of these services.
Interested parties confirm that they have their registered office/are domiciled in Switzerland and that they are legally competent.
Moving service
Use of the moving service: The Comparis moving service is aimed at interested parties who are interested in moving and/or cleaning services and who submit their details to advanti via the online platform.
The Comparis moving service shall make it possible for interested parties to receive up to five quotes for moving and/or cleaning services from companies registered with advanti. The use of the Comparis moving service is free of charge for interested parties vis-à-vis advanti and does not oblige them to commission a registered company or to enter into any additional commitments.
Services: The Comparis moving service offers an online platform for moving and cleaning services. advanti forwards the enquiries it receives to the respective registered companies according to the service selected. The request does not constitute a binding order, but only a request for quotes. The quotes for moving and/or cleaning services submitted by the registered company shall neither be viewed nor checked by advanti. In any case, the contract shall be concluded exclusively between the interested party and the registered company. advanti shall never be a party to the contract and shall assume no responsibility for the performance of the requested moving and/or cleaning services. It shall also assume no liability for any damages that could be caused by the commissioned companies. There is a separate agreement governing the compensation between advanti and the registered company; there is no obligation to surrender property or possession vis-a-vis the interested parties.
Tradesperson service
Use of the tradesperson service: The Comparis tradesperson service is aimed at interested parties who are interested in tradesperson services and who submit their details to advanti via the online platform.
The Comparis tradesperson service shall make it possible for interested parties to receive up to five quotes for tradesperson services from companies registered with advanti. The use of the Comparis tradesperson service is free of charge for interested parties vis-à-vis advanti and does not oblige them to commission a registered company or to enter into any additional commitments.
Services: The Comparis tradesperson service offers an online platform for tradesperson services. advanti forwards the enquiries it receives to the respective registered companies according to the service selected. The request does not constitute a binding order, but only a request for quotes. The quotes for tradesperson services submitted by the registered company shall neither be viewed nor checked by advanti. In any case, the contract shall be concluded exclusively between the interested party and the registered company. advanti shall never be a party to the contract and shall assume no responsibility for the performance of the requested tradesperson services. It shall also assume no liability for any damages that could be caused by the commissioned companies. There is a separate agreement governing the compensation between advanti and the registered company; there is no obligation to surrender property or possession vis-à-vis the interested parties.
Broker service
Use of the broker service: The Comparis broker service is aimed at interested parties who are interested in property valuation services and who submit their details to advanti via the online platform.
The Comparis broker service shall make it possible for interested parties to order a free, non-binding property valuation within the meaning of an initial guideline value for a house or apartment in Switzerland ("Comparis property valuation") as a practical online tool for property valuation. Furthermore, the Comparis broker service finds registered estate agents as well as estate agents who have real estate experts who can provide a real estate valuation through advanti. The use of the Comparis tradesperson service is free of charge for interested parties vis-à-vis advanti and does not oblige them to commission a registered company or to enter into any additional commitments.
Services:
Comparis property valuation: information (such as contact and property details [namely property location, living space, year of construction, etc.]) shall be used in accordance with the form for the online property valuation and forwarded by advanti to its registered estate agents. Reference shall be made to the product description on the website www.comparis.ch. The estimated market value is considered to be a guideline valuation and does not replace the valuation provided by an estate agent. Interested parties may contact an estate agent to request a free, non-binding valuation of the property.
The online property valuation can be viewed by the interested party free of charge via a link that is sent to the interested party's e-mail address.
The free Comparis property valuation is provided without guarantee. The information about the property was provided by the interested party. To the extent permitted by law, advanti shall in no event be held liable (including for negligence) for any damages, including direct or indirect consequential damages, that may arise from the use of the resulting market value. In particular, advanti expressly excludes any liability for damages arising from actions, omissions or decisions made by the interested party based on this estimated market value.
Finding of estate agents and property valuation on site: when using the Comparis brokerage service, information (such as contact and property details) shall be forwarded to a registered external estate agent. The estate agent can then contact the interested party to offer a free, non-binding property valuation on site or to discuss other services in connection with a possible property sale. The offer of a property valuation is aimed in particular at property owners who are considering selling their property. There is no entitlement to the provision of such an estimate. In cases where the work needed to provide a professional valuation goes beyond the usual level or is more complex than usual, advanti reserves the right not to broker this offer. All further steps, such as the discussion of conditions or contractual terms, shall be the responsibility of the interested party and must be clarified directly with the estate agent – in particular, if the estate agent is to be commissioned to sell the property. In any case, the contract shall be concluded exclusively between the estate agent and the interested party. advanti shall never be a party to the contract and therefore shall assume no liability for the estate agent or its actions.
Requirements for estate agents: The Comparis broker service guarantees that a check is carried out—with the care customary to business and by means of a self-declaration provided by each estate agent—to determine whether the estate agents fulfil all of the quality criteria defined by the Comparis broker service. Estate agents are obliged to meet all of the following requirements:
Estate agent's office:
has been in the Commercial Register (Switzerland) for at least three years
has no record of ongoing or completed bankruptcy proceedings
has executed at least 15 sales transactions in the last calendar year
has liability insurance coverage of at least CHF 1 million
Real estate expert:
employs at least two estate agents (who can deputise for each other)
all of the estate agents who visit parties interested in the Comparis brokerage service have a recognised real estate qualification, as well as at least three years of professional experience (as an estate agent). trainee estate agents (i.e. those with less than three years of professional experience) must be supervised by an experienced estate agent
uses a professional valuation tool from Wüest Partner, IAZI or Fahrländer & Partner
Back office:
provides their users with a staffed back office from Monday to Friday (business hours)
This check is carried out at the beginning of the collaboration and is then repeated annually. The quality criteria can be adjusted by advanti at any time; for existing estate agents, however, changes will only come into effect from the next inspection. advanti assumes no liability for the reliability, competence or quality of the estate agents or for the accuracy of the information they provide. If you have any doubts in this regard, please inform advanti immediately.
Compensation: In the event of a successful establishment of contact between interested parties and estate agents, advanti shall receive remuneration from the estate agent. This remuneration can take the form of a share of the estate agent's commission or a separate payment for the brokerage service. It should be noted that advanti does not act on behalf of the interested party. With this regulation on the remuneration of the Comparis broker service, it is confirmed and accepted that advanti shall retain the remuneration received and is not obliged to surrender it – even if it were assumed that advanti is acting on behalf of the interested party.
Data privacy
The Data Privacy Statement of the Decisis Group shall apply. The interested party shall agree to the transmission of the data provided by them to advanti and the registered companies/ estate agents. advanti regularly informs interested parties about news relating to its services. You can unsubscribe at any time.
Disclaimer
advanti shall offer its services without warranty or guarantee. In particular, advanti cannot guarantee that interested parties will receive the desired offers or that a contract will be concluded between a registered company/estate agent and the interested party. In addition, the exclusions of liability shall apply in accordance with the above provisions.
advanti reserves the right to change or discontinue the services and other services provided via the online platform at any time and without prior notice.
Final provisions
Amendments: advanti shall be entitled to revise the Terms and Conditions of Use, where necessary. The most recent version available shall always be decisive, and previous versions shall be replaced by the new version.
Severability clause: Should individual provisions of these Terms and Conditions of Use be wholly or partially invalid, this shall not affect the legal validity of the remaining provisions, regardless of the reason for the invalidity. The invalid provision shall be replaced by a new valid provision that comes closest to the invalid provision in terms of its economic effects.
Language: In the event of contradictions between different language versions of the contractual documents, only the German language version shall prevail.
Applicable law and place of jurisdiction: These Terms and Conditions of Use are subject to Swiss law exclusively, to the extent permitted by law, excluding the rules of private international law. Unless any other place of jurisdiction is stipulated by law, the sole place of jurisdiction for any disputes arising out of or in connection with the services of advanti, namely the broker service, moving service and tradesperson service, as well as property valuation, shall be the city of Zurich, Switzerland.
