advanti AG Terms of Use

Scope of application: advanti AG, with its registered office at Birmensdorferstrasse 108, 8003 Zurich («advanti»), offers intermediary services in the areas of moving service, tradespeople service and broker service, as well as property valuation (collectively referred to as «Services»). As a sister company of comparis.ch AG, advanti offers these Services via the online platform(s) of comparis.ch AG («Online Platform»). The Services are provided by advanti. For selected tradespeople services, advanti works in partnership with Houzy AG («Houzy»), a subsidiary of Baloise.

These Terms of Use apply to the private and commercial use of these Services by prospective customers. The following provisions contain detailed regulations on the use of these Services.

Interested parties confirm that they are domiciled/resident in Switzerland and have legal capacity.

Moving service

Use of the moving service: The Comparis moving service is aimed at prospective customers who are interested in moving and/or cleaning services and who transfer their data to advanti via the Online Platform.

The Comparis moving service allows prospective customers to receive up to five quotes for moving and/or cleaning services from companies registered with advanti. Use of the Comparis moving service is free of charge for prospective customers vis-à-vis advanti and does not oblige them to commission a registered company or impose any other obligations. 

Services: The Comparis moving service offers an Online Platform for moving and cleaning services. advanti forwards the submitted requests to the registered companies according to the selected service. The request does not constitute a binding order; it is solely a request for quotes. advanti neither views the quotes for moving and/or cleaning services sent by registered companies nor reviews their content. In any case, the contract is concluded exclusively between the prospective customer and the registered company. advanti is never a party to the contract and assumes no responsibility for the performance of the requested moving and/or cleaning services and excludes all liability for any damage that may be caused by the contracted companies. Compensation between advanti and the registered company is regulated separately; there is no obligation to disclose information to interested parties. 

Trades service

Use of the trades service: The Comparis trades service offers an Online Platform for trades services. It is aimed at prospective customers who are interested in trades services (e.g. painting work) and who submit their request and data to advanti via the Online Platform. Interested parties are transparently informed by advanti on the Online Platform about when and how a trades service will be provided in collaboration with Houzy. This is a commercial partnership; the remuneration between advanti and Houzy is regulated separately. There is no obligation to hand over information to prospective customers.

Use of the trades service is free of charge for interested parties vis-à-vis advanti and Houzy and does not oblige them to commission a company registered with advanti or a trades company brokered by Houzy, nor does it impose any other obligations.

Services without collaboration with Houzy: advanti forwards the submitted requests and data to the companies registered with it according to the selected service. The request does not constitute a binding order; it is solely a request for quotes. Interested parties are able to receive up to five quotes. The quotes for tradespeople services submitted by the registered company are neither viewed by advanti nor is their content checked. In all cases, the contract is concluded exclusively between the prospective customer and the registered company. advanti is never a party to the contract and assumes no responsibility for the performance of the requested tradespeople services and excludes any liability for damage that may be caused by the contracted companies. Compensation between advanti and the registered company is regulated separately; there is no obligation to disclose information to interested parties.

Services in collaboration with Houzy: advanti forwards all submitted requests and data to Houzy. In western Switzerland, Houzy provides these Services under the brand Devis.ch (devis.ch). Houzy processes the enquiries and data of interested parties independently, according to its own process and under its own responsibility. Houzy may contact the prospective customer by phone, WhatsApp or email. Interested parties can find further information on how Houzy processes their data in the data privacy statement from Houzy . Houzy forwards the requests and data to suitable tradespeople from its network without the involvement of advanti. The request does not constitute a binding order; it is solely a request for quotes. Interested parties are given the opportunity to receive up to four quotes. The quotes submitted by the tradespeople are neither viewed by advanti nor is their content checked. advanti is never a party to the contract and assumes no responsibility for the execution of the requested trades services and excludes any liability for damage that may be caused by the contracted tradespeople.

Broker service 

Use of the broker service: The Comparis broker service is aimed at prospective customers who are interested in property valuation services and who transfer their data to advanti via the online platform.  

The Comparis broker service enables interested parties to request a non-binding property valuation free of charge as a practical online tool for property valuation, providing an initial benchmark for a house or apartment in Switzerland («Comparis property valuation»). Furthermore, the Comparis broker service arranges registered property agents as well as property agents for a property valuation by a property expert through advanti. Use of the Comparis broker service is free of charge for prospective customers vis-à-vis advanti and does not oblige them to appoint a registered property agent or impose any other obligations.

Services:

Comparis property valuation: Information (such as contact and property details [namely property location, living space, year of construction, etc.]) is used in accordance with the form for the online property valuation and forwarded by advanti to its registered property agents. Please refer to the product description on the website www.comparis.ch. The market value estimate is to be understood as a guideline and does not replace an on-site valuation by a property agent. Interested parties may contact us regarding the offer of a free, non-binding property valuation by a property agent. 

The online property valuation is made available to the interested party free of charge for viewing via a link sent to the email address provided. 

The free Comparis property valuation is provided without guarantee. The information about the property was provided by the interested party. To the extent permitted by law, advanti shall in no event be liable (including for negligence) for any damages, including direct or indirect consequential damages, that may arise from the use of the resulting market value. In particular, advanti expressly excludes any liability for damages resulting from any actions taken, omissions made, or decisions made by the interested party based on this market value estimate.

Connecting you with a property agent and on-site property valuation: When using the Comparis broker service, information (such as contact and property details) is forwarded to a registered external property agent. They may then contact the interested party to offer a free, no-obligation property valuation on site or to discuss further services in connection with a possible property sale. The offer of a property valuation is aimed in particular at property owners who are considering selling their property. There is no entitlement to the performance of such a valuation. In cases where the effort or complexity of a professional valuation exceeds the usual level, advanti reserves the right not to arrange this offer. All further steps, such as discussing terms or contractual conditions, are the responsibility of the interested party and must be clarified directly with the property agent – especially if the property agent is to be entrusted with the sale of the property. In any case, the contract shall be drawn up exclusively between the property agent and the interested party. advanti shall never be a party to the contract and therefore assumes no liability for the property agent or their actions.

Requirements for property agents: The Comparis broker service guarantees that it has checked, with due diligence and based on the information declared by each property agent, whether said property agents fulfil the quality criteria of the Comparis broker service in their entirety. Property agents are obliged to meet the following requirements cumulatively:

Property agency:

  • have been in the commercial register (Switzerland) for at least 3 years

  • have no record of ongoing or completed bankruptcy proceedings

  • have executed at least 15 sales transactions in the last calendar year

  • have liability insurance coverage of at least CHF 1 million

Property expert:

  • employ at least two property agents (who can substitute for each other)

  • can prove that all property agents who visit prospective clients of the Comparis broker service have a recognised real estate qualification, as well as at least 3 years of professional experience (as a property agent). Trainee property agents (i.e. with less than 3 years of professional experience) must be supervised by an experienced property agent

  • use a professional valuation tool from Wüest Partner, IAZI or Fahrländer Partner

Back office:

  • provide their users with a staffed back office from Monday to Friday (business hours)

This check takes place at the beginning of the collaboration and is then repeated annually. advanti can change its quality criteria at any time; however, for existing property agents, any changes only take effect as of the next inspection. advanti is not responsible for the reliability, competence or quality of the property agents, or for the accuracy of the information they provide. If you have any doubts in this regard, please inform advanti immediately.

Compensation: In the event of successful contact mediation between prospective customers and the real estate agent, advanti receives remuneration from the real estate agent. This remuneration can take the form of a share in the estate agent’s commission or a separate payment for the broker service. It should be noted that advanti does not act on behalf of the prospective customer. With this arrangement pertaining to the remuneration of the Comparis broker service, it is confirmed and accepted that advanti keeps the remuneration it receives and is not obliged to pay it to you – even if it were assumed that advanti was acting on behalf of the interested party. 

Data privacy

The Data privacy statement of the Decisis Group. The prospective customer hereby agrees to the data they provided being transferred to advanti and the registered companies/estate agents or, in the case of the partnership with Houzy, to advanti and Houzy, as well as to the tradespeople procured. advanti regularly informs prospective customers about news relating to its services. You can unsubscribe at any time.

Disclaimer of liability

advanti offers its services without warranty or guarantee. In particular, advanti cannot guarantee that interested parties will receive the offers they want or that a contract will be concluded between a registered company/estate agent and the interested party. In addition, the disclaimers apply in accordance with the above provisions. 

advanti reserves the right to change or terminate the services and other services provided via the online platform at any time and without prior notice. 

Final provisions

Changes: advanti is entitled to revise the Terms of Use as necessary. The most recent available version shall always apply and previous versions shall be replaced by the new version.

Severability clause: Should individual provisions of these Terms of Use be invalid in whole or in part, this shall not affect the legal validity of the remaining provisions, regardless of the reason for the invalidity. The invalid provision shall be replaced by a new valid provision which comes closest to the invalid provision in terms of its economic effects.

Language: In the event of contradictions between different language versions of the contractual documents, only the German language version shall prevail.

Applicable law and place of jurisdiction: To the extent permitted by law, these Terms of Use are subject to Swiss law exclusively. The conflict of laws provisions therefore do not apply. Unless any other place of jurisdiction is stipulated by law, the sole place of jurisdiction for any disputes arising out of or in connection with the services of advanti, namely the broker service, the moving service and the trades service, as well as property valuation, will be the city of Zurich, Switzerland.
