1. Introduction

1.1 These General Terms and Conditions regulate the contractual relationship between customers and comparis.ch AG, Birmensdorferstrasse 108, CH-8003 Zurich ("Comparis"), with regard to the Property Valuation Plus; in each case referred to as a "contract".

1.2 The conclusion of the contract is only permitted for adult, legally competent private individuals, insofar as they are resident in Switzerland or in the Principality of Liechtenstein ("customers").

2. Conclusion of the contract

2.1 The online presentation of the Comparis Real Estate Valuation Plus on its website www.comparis.ch does not constitute a binding contractual offer. By clicking on the "Pay now" button, the customer places a binding order, accepts the applicable General Terms and Conditions and confirms the correctness of the information entered. Comparis reserves the right to decide whether to accept the order. The contract is concluded by the written confirmation of the order by email from Comparis or with the activation of the Property Valuation Plus on the user account. The price quoted at the time of the order, which is repeated in the online order confirmation, applies.

3. Service

3.1 The binding order of the Property Valuation Plus requires a personal user account. Registration with myComparis is required to access this user account.

3.2 The scope and content of the Property Valuation Plus is described in the current product documentation on the website www.comparis.ch and in the interactive example provided. Comparis is entitled to adjust these at any time. The customer must inform themselves about the scope and content before concluding the contract. In particular, they acknowledge that the Property Valuation Plus is created in particular using machine learning methods and with the inclusion of artificial intelligence.

3.3 Comparis makes the Property Valuation Plus available to its customers in the user account. By making it available, Comparis fulfills the contract. The Property Valuation Plus can be downloaded by the customer as a PDF as often as desired during the same period. The customer is responsible for accessing the user account and for the further use and storage of the Property Valuation Plus. In particular, the customer is not entitled to receive further data for download, otherwise or in a special form for further use. The mandatory provisions of the Data Protection Act are reserved.

4. Duties and obligations of the customer

4.1 The customer is responsible for which documents they make available to Comparis and which data they collect. In doing so, they must observe the relevant legal provisions and good morals, in particular the Data Protection Act, the Copyright Act and criminal law. Comparis may delete content that, in its opinion, violates applicable law or good morals or is otherwise not in accordance with the purpose of the user account or the range of services or violates these General Terms and Conditions, without prior notice and without compensation.

5. Cost of services

5.1 The price for the Real Estate Valuation Plus is in Swiss francs including VAT. Comparis reserves the right to change prices at any time. The price applicable at the time of ordering is decisive for the customer. Payment is made in advance via credit card or Twint via a Comparis service provider. The debit will be made when the order is placed.

6. Access to the user account

6.1 Comparis can block the customer's access to the user account immediately and at any time for important reasons. This will terminate the right to access the user account and the Property Valuation Plus stored in it. Comparis may close the customer's account and delete their data stored at Comparis without notice. There is no entitlement to access to the range of services offered by Comparis. A claim for reimbursement of the price paid for the Property Valuation Plus is excluded.

7. Warranty and disclaimer

7.1 The Property Valuation Plus is carried out without guarantee. The information about the property comes exclusively from the customer. Their correctness and completeness are not checked. No inspection takes place.

7.2 Warranties, guarantees and assurances as well as liability and rights to defects are excluded to the extent permitted by law, in particular with regard to availability, completeness, correctness, freedom from errors and suitability for a specific purposes of the Property Valuation Plus created, the user account provided as well as other content and other services.

7.3 To the extent permitted by law, Comparis excludes any liability (including for its organs, employees and auxiliary persons). Comparis is not liable for slight or medium negligence or for direct and indirect damage or consequential damage (loss of profit, third-party claims) that may arise in particular from the use of the results of the Property Valuation Plus. In particular, Comparis is expressly not liable for damages arising from the action, omission of action or decision made by the customer based on the results of the Property Valuation Plus.

8. Intellectual property rights

8.1 All rights to the Comparis website, services and content are exclusively reserved to Comparis and its licensors. No rights are transferred or granted to customers through the use of the Comparis website, services and content. This does not apply to the non-exclusive right of use of the Property Valuation Plus granted to the customer.

9. Data protection

9.1 With regard to data protection, the Privacy Policy applies. The privacy policy does not become part of the contract between the customer and Comparis. It can be changed by Comparis at any time. Comparis processes personal data (name, address, etc.) and valuation-related data of its customers. The personal data is processed in particular for the purpose of creating the Property Valuation Plus and forwarded to any service providers in connection with this activity. For further data processing by Comparis, reference is made to the above Privacy Policy.

10. Final provisions

10.1 Comparis reserves the right to amend these General Terms and Conditions at any time. The current version applies; earlier versions are replaced by the new version. Such changes do not apply to orders that have already been confirmed.

10.2 Should individual provisions of these General Terms and Conditions be invalid in whole or in part, this shall not affect the legal validity of the remaining provisions, regardless of the reason for the invalidity. The invalid provision shall be replaced by a new valid provision that comes as close as possible to the economic effects of the invalid provision.

10.3 In the event of contradictions between different language versions of the individual contractual documents, only the German version shall prevail.

10.4 These General Terms and Conditions as well as any disputes, claims or demands arising from the contract or in connection with it or its subject matter or conclusion are subject to Swiss law. Zurich is the exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship, insofar as this does not conflict with mandatory statutory provisions.
