1. Introduction

These General Terms and Conditions for moving and cleaning companies, including the appendix «Comparis Moving Service Code» and the current «Comparis Moving Service Communication Guidelines» (hereinafter the «GTC»), regulate the contractual relationship between «advanti» AG, Birmensdorferstrasse 108, 8003 Zurich (hereinafter «advanti»), and the moving and/or cleaning companies (hereinafter each a «company») which use the «Comparis Moving Service» operated by «advanti» on www.comparis.ch, and they apply in particular to any use of the moving service by the company.

2. Use of the Comparis Moving Service

The «Comparis Moving Service» is an Internet platform. Private and commercial users (hereinafter «prospective customers») find offers for moving and cleaning services from companies registered on the platform. Enquiries and user data are transmitted exclusively to registered companies that have agreed to the validity of these GTC. The registration of the companies and the purchase of enquiries is carried out via www.topmovers.ch. Moving and/or cleaning quotes that the company sends to a prospective customer are not reviewed or checked by «advanti». Contracts for the provision of moving and/or cleaning services are concluded exclusively between the «prospective customer» and the «company».

3. Costs for «prospective customers»

The use of the «Comparis Moving Service» is free of charge for «prospective customers». «Prospective customers» incur no costs when submitting an enquiry and do not place an order, but merely request offers.

4. Transmission of requests to companies and activation of contact details

The «Comparis Moving Service» automatically forwards enquiries received from «prospective customers» in anonymised form to companies via a distribution mechanism defined by «advanti». «Advanti» is not obliged to check or verify enquiries before forwarding them to the company. Companies that receive an anonymised enquiry have the option, for a fee, to activate the contact details of the enquiry so that they can send the «prospective customer» an offer for the requested moving and/or cleaning service. A maximum of five companies can activate the contact details per enquiry.

5. Costs for companies

The «company» undertakes to pay a fee for each enquiry for which it activates the contact details in its user account. The amount of the fee depends on the details in the enquiry concerning the type and scope of the requested service (e.g. the specified size of the apartment) and is calculated according to the applicable price list of «advanti», which the «company» can view in its user account. «Advanti» may adjust the price list at its sole discretion from time to time. In addition, «advanti» may offer enquiries to companies at a reduced price if no company decides to purchase after 7 hours. Enquiries with a reduced fee are excluded from the refund in accordance with Section 5 of these GTC. Subject to a refund under Section 5 of these GTC, the fee is in any case due for activating the contact details of an advertisement. The fee is payable regardless of whether the «company» submits a quote and whether a contract is concluded between the «company» and the «prospective customer». All fees are stated in Swiss francs (CHF), including statutory VAT. The «company» may pay the fee using the payment methods currently accepted by «advanti» (for example, credit card). The contact details of the «prospective customer» will only be activated after successful payment. Apart from the fee for activating contact details, the «company» does not owe «advanti» any further fee for the use of the «Comparis Moving Service».

6. Refunds and cancellations of requests

If it is impossible to contact the «prospective customer» due to missing or incorrect information in the request, the «company» may object to the request and apply for a credit of the fee paid for activating the contact details of the relevant request. The «company» may also object to duplicate enquiries (i.e. the activation of multiple identically submitted requests) and apply for a credit for the multiple (but not the first) activation fees paid for the same contact details of the same request. A complaint must be submitted in writing to advanti AG, Birmensdorferstrasse 108, 8003 Zurich, or by email to umzugsservice@comparis.ch within 4 working days of the date of activation of the contact details, stating the reason. If, in the opinion of «advanti», a timely complaint is justified, the fee paid will be refunded by crediting the «company»’s user account. This credit will be offset against the next fee due and will expire upon termination of the contract. No cash payment will be made. Enquiries at a reduced price are excluded from the refund.

7. Obligations for companies

If «prospective customers» request a quote for a moving and cleaning service, either as an individual request or in combination with a moving service, the «company» is obliged to always prepare the quote including a handover guarantee/acceptance guarantee – unless the «prospective customer» expressly excludes this.

8. Reviews

The «company» expressly agrees that «advanti» may have its moving and/or cleaning service evaluated by the «prospective customer» whose request was submitted via the «Comparis Moving Service». These ratings may be displayed to other «prospective customers». The ratings are the property of «advanti». Incorrect or questionable ratings of the «company» by the «prospective customer» may be complained about in writing to umzugsservice@comparis.ch. The «Comparis Moving Service» reserves the right to amend or delete ratings and comments from prospective customers and assumes no liability to the «company» in this regard.

9. Duration and termination

The contract between the «company» and «advanti» is concluded for an indefinite period. There is no minimum contract term. Both the «company» and «advanti» are each entitled to terminate the contract at any time with effect from the following working day. Termination by the «company» must be made in writing to advanti AG, Birmensdorferstrasse 108, 8003 Zurich, or by email to umzugsservice@comparis.ch. Termination by «advanti» must be made in writing or by email to the contact details stored in the user account of the «company».

10. Data protection

This Privacy Policy applies to the processing of personal data of the Company and the persons acting on behalf of the Company.

The data of prospective customers transmitted to the Company via the Comparis Moving Service may only be used by the Company to prepare the requested offer and to contact the prospective customer to transmit this offer. Use for other purposes (in particular advertising purposes) and the forwarding, further use or reproduction of such content in electronic or printed form is only permitted with the express written consent of advanti.

advanti may provide the Company with information about other products and services (e.g. via newsletters, release information or push notifications on mobile devices). The Company or the persons acting on behalf of the Company may unsubscribe from these notifications at any time via the corresponding link in the newsletter or the settings of their device (opt-out).

11. Disclaimer and indemnification

The use of the Comparis Moving Service by the Company and the conclusion of the contract with prospective customers is at the Company’s own risk. advanti provides the services under the contract without warranty and without guarantee. In particular, advanti does not warrant or guarantee (i) the permanent and/or continuous availability of the Comparis Moving Service, (ii) the accuracy and completeness of the data transmitted, (iii) a certain number of enquiries, (v) the resulting conclusion of contracts and (vi) the payment by the prospective customer for the services provided by the Company. Subject to mandatory statutory provisions, any liability of advanti arising from or in connection with the Contract is excluded. The Company shall ensure that its employees and agents also comply with these GTC. The Company undertakes to indemnify and fully hold advanti harmless from all claims by prospective customers and third parties that a prospective customer or a third party asserts against advanti, its bodies or employees in connection with the provision of services by the Company and/or the violation of this Agreement.

12. Miscellaneous

advanti may adjust or discontinue the Comparis Moving Service and the services provided via the Comparis Moving Service at any time without prior notice. If the Company suspects misuse or a violation of these GTC or applicable law, advanti may block access to the Comparis Moving Service at any time with immediate effect. advanti is entitled to amend these GTC from time to time, whereby advanti will inform the Company in writing or by email of any amendment to the GTC. The Company can view the currently valid version of the GTC in the User Account. The new GTC are to be accepted by the Company or are deemed to have been accepted by the Company as soon as it has been activated in its User Account after the new GTC have been activated by advanti. Agreements between advanti and the Company that deviate from these GTC are only valid in writing. Verbal ancillary agreements are excluded.

13. Applicable law and place of jurisdiction

The contract is exclusively subject to Swiss law, to the exclusion of the rules of international private law. The exclusive place of jurisdiction for all disputes arising from or in connection with this contract (or subsequent amendments thereto), including disputes regarding interpretation, performance, breach or termination, is the city of Zurich, Switzerland.

Comparis Moving Service Code

advanti AG, with the Comparis Moving Service of comparis.ch AG, generally adheres to the following standards in its business activities:

Acceptance criteria for contracting companies

Companies may register on the Comparis Moving Service platform if they:

  • have been listed in the commercial register (Switzerland) for at least 6 months or 12 months (Canton of Zurich)

  • have no entries on current or completed bankruptcy proceedings

  • have a functioning website that contains at least one valid contact detail for the provider

  • can present a valid credit card

  • have never been blocked by advanti AG in the past

  • offer relocation services/cleaning work for private individuals and that

  • this is also evident from the commercial register

  • are not economically affiliated with an already registered company (e.g., are under common control with such a company), and

  • accept the contractual conditions of advanti AG

The above criteria apply on the condition that the maximum number of providers that advanti AG can administratively manage in a sales region has not yet been reached or there is no waiting list (providers not admitted for this reason will be placed on the waiting list).

Exclusion criteria for contracting companies

Companies are excluded from the relocation service platform if they:

  • do not meet, or no longer meet, one or more of the admission criteria

  • have an average rating of 3.5 or below on the relocation service platform, based on at least 10 ratings

  • change the user profile (name, contact details) without the express permission of advanti AG

  • have received more than 5 complaints in the last 12 months, either publicly accessible or received directly by advanti AG

  • Have been inactive on the relocation service platform for 12 months or more (i.e.

    no purchases made, no credit deposited, and no activity in the user profile for over one year)

  • are listed in the commercial register as deleted or in liquidation

  • repeatedly fail to comply with the communication guidelines issued by advanti AG or fail to do so despite a reminder

  • behave unlawfully, in violation of this Code, or otherwise in a manner detrimental to the reputation of Comparis

  • do not, or no longer, allow themselves to be rated on comparis.ch or to have their services commented on (unless they can prove that such ratings or comments are unlawful)

  • actively influence customer reviews, for example by requesting the deletion, modification or resubmission of a review without resolving the underlying problem, if one existed.

  • use automatic tools for lead generation

Criteria for distribution of offer/contact requests

advanti AG, through the relocation service, mediates the offer/contact requests for each inquiry:

  • to a maximum of 5 providers registered on the platform

  • in the order of valid offers received from providers via the relocation service in response to an inquiry

Behaviour of our contracting companies

The companies registered on the relocation service platform undertake towards advanti AG to:

  • to adhere to the current communication guidelines issued by advanti AG

  • to adhere to this Code

  • to behave fairly, transparently and respectfully towards customers

  • to comply with applicable law and the Price Disclosure Ordinance, the latter as if their service were listed in Art. 10

  • to cooperate fully, at their own expense, with advanti AG in investigating customer complaints and where there are indications that a company does not, or no longer, fully comply with this Code; this obligation includes true and complete responses to reasonable enquiries upon first request

The Code is part of the agreement between the contracting company and advanti AG. Any breach of this entitles advanti AG to terminate the agreement immediately.

Communication Guidelines for the Comparis Moving Service

The providers registered with the Comparis Relocation Service undertake to adhere to the following guidelines when communicating with the users referred to them by advanti AG.

Contacting referred users

  • Users referred by advanti AG shall only be contacted by the provider during the specified availability hours.

  • The user shall be contacted by telephone no more than 3 times within 48 hours.

  • If telephone contact is unsuccessful, the provider shall contact the user once via the specified email address.

  • If contact via the email address provided by the user is unsuccessful, the provider shall not make any further contact attempts.

Addressing referred users

  • Upon successful contact, the provider shall identify itself by its own company name.

  • The provider shall identify itself as a contracting company of the Comparis Relocation Service.

  • The provider shall refer to the offer request submitted by the user via comparis.ch.

  • The provider shall not present itself as an employee of comparis.ch.

Advising referred users

  • The provider shall present its service to the user in a complete and transparent manner.

  • The provider shall accept without objection if the user wishes to forego an appointment.

  • The provider shall accept without objection a poor rating from the user, provided that it has actually delivered a consultation or service.
