ELVIA (Motor legal protection)
Individual: policy holder as:- driver of a private vehicle
- owner and registered vehicle keeper
- contractual party in connection with vehicles
- holder of a driving licence for vehicles in road traffic
Other insured individuals:
- passengers in vehicles driven by the policy holder
- authorised driver or co-driver of a vehicle registered in the name of the policy holder, exclusively for the consequences of a traffic accident or on account of the infringement of traffic regulations
Family: policy holder and individuals living or residing in common household as:
- driver of a private vehicle
- owner and registered vehicle keeper
- contractual party in connection with vehicles
Other insured individuals:
- passengers in vehicles driven by the policy holder or family members
- authorised driver or co-driver of a vehicle registered in the name of an insured person, exclusively for the consequences of a traffic accident or on account of the infringement of traffic regulations
Up to CHF 250,000 per case including fines and bail (advance)
- Expert opinions and analyses ordered by the CAP or a civil, prosecuting or administrative authority
- Mediation costs
- Blood alcohol, drug analyses and medical examinations in the case of drunkenness and drug consumption
- Administrative costs levied in the case of the withdrawal of a driving licence, its reissue, in the case of a warning or other punitive measures
Legal venue in Europe or a non-European state that has joined the "Green Card" agreement.
A waiting period of 90 days applies to contractual disputes and legal advice. There is no waiting period for all other legal cases.
Legal cases involving …- wilful bringing about of a state of affairs leading to legal proceedings
- exceeding the speed limit within a built-up area from 30 km/h, out of town from 40 km/h, on motorways from 50 km/h
Cases which legally require an external lawyer give the insurance holder the right to propose the legal representative of his choice. If the insurer rejects this attorney, the holder may suggest three other lawyers from which the CAP must make their choice.
The insurance holder and the CAP must agree upon an arbitrator. Decisions made by the concordat for arbitral jurisdiction apply.
Notice of termination must be handed in at least three months prior to expiry.
According to contract duration as stated in insurance policy.
Action in case of a claimThe insurer must be informed in writing immediately. -

- Legal advice (for law relating to neighbouring owners, inheritance and family law) up to a maximum of CHF 500

- Enforcement and bankruptcy costs
- Notary costs and fees

- criminal proceedings in the case of wilful offences
- repudiating liability claims
- disputes between co- or joint owners, shareholders or cooperative members

- disputes in connection with an independent full-time or part-time occupation, a (administrative board) mandate relationship or as partner
- disputes regarding claims assigned to the policy holder
