Those who apply for a job and are invited for interview are already taking a huge step in the direction of a new place of work. A slight downside here can be costs that arise for the journey any overnight stay. This is particularly valid if travel abroad is required. The fact is, however, that the applicant has a right to have costs reimbursed, unless the acceptance of costs has been clearly refused from the outset of the process.

Legal experts assume that an invitation to interview from a potential employer to an applicant constitutes a contractual relationship. As a consequence, there arises the obligation under OR Art. 402 Para. 1, that costs associated with the interview must be reimbursed.

If the employer does not comply with this ruling, the applicant can ask about the reimbursement of costs. However, caution and tact are recommended here: it is advised that a claim for costs is only made once the application process is completed and a rejection has been received. Otherwise the applicant risks leaving a negative impression based on this request and may not be selected for the position. In an extreme case, the reimbursement for outlay can be applied for through the courts but this is of course only worthwhile for very large amounts.
