1. Introduction
1.1 In the following paragraphs “Comparis” will be used as an abbreviation for the company comparis.ch Ltd, as entered in the Commercial Registry. The term "participant" refers to Comparis users, who have accepted these service and business conditions when registering with myComparis.
The following service and business conditions will be referred to as "SBC".
1.2 The SBC regulate the rights and obligations between Comparis and the participant. Terms of use and all legal indications on the website www.comparis.ch are regarded as integral components.
1.3 If the participant is not in agreement with these terms, he will not be permitted to use any services requiring registration with myComparis.
2. Commencement, duration and termination of the contract
2.1 The contract with the participant comes into effect upon acceptance of the SBC when registering with myComparis. There is no right of registration as a user.
2.3 The contract becomes invalid when registration with myComparis is deleted.
2.4 If the participant contravenes contractual conditions, uses the services for illegal purposes or if there is any other significant reason, Comparis retains the right to terminate the contract with immediate effect and to delete myComparis registrations. Any fees already paid will be retained by Comparis.
3. Service access
3.1 The technical service access is the responsibility of the participant. Access is by Internet via the participant's selected provider
4. Rights and obligations of the participant
4.1 The participant is not permitted to transfer use of or access to Comparis services to third parties. In particular, it is the responsibility of the participant to ensure that third parties cannot access his user identification and passwords. The participant must change his passwords at irregular intervals.
4.2 The participant bears all consequences resulting from the use of Comparis services. If there is reason to believe that unauthorised third parties have gained knowledge of ID characteristics, the password must be changed immediately. The participant must check all data he enters or transmits for completeness and accuracy.
4.3 In case of violation of the above terms, Comparis retains the right to block certain domains (e.g. individual comparison) or access to certain domains immediately.
5. Disclaimers
5.1 Within legal limitations, Comparis is in no way liable (including cases of negligence) for loss or damage, including direct and indirect consequential damage, resulting from access to, use of or any other appropriation of their published information and views, even if Comparis has been made aware of the possibility of such damage. This equally applies to Comparis links to other websites.
5.2 In particular, Comparis is explicitly not liable for damage resulting from action, omission of action or decisions taken by third parties with regard to the participant. Comparis has no influence on this.
5.3 Other websites can be reached via links from the Comparis website. Comparis cannot make any guarantees or accept any liability for these websites and their content.
6. No endorsement
6.1 Information published by Comparis is neither a recommendation nor an incitement to buy or sell any particular products, services or transactions. All information is without guarantee.
6.2 www.comparis.ch and the services presented on this site are not intended for persons whose place of jurisdiction prohibits access to this website (e.g. for reasons of nationality, the participant's place of residence or for any other reason). The use of the service is not permitted for persons with such limitations. It is the responsibility of the participant to obtain the necessary information pertaining to this issue. If the participant uses the Comparis service from abroad, he must in particular be aware that there could be import and export restrictions, which he may be contravening, for the encoding algorithms.
7. Guarantee
7.1 Comparis makes every effort to ensure that their services are accurate and up-to-date, however, they cannot explicitly or implicitly assure or guarantee accuracy, reliability or completeness. All services, tables, views, functions, price indications and other information are given without guarantee. Comparis explicity reserves the right to alter their published information and services at all times.
7.2 Comparis cannot guarantee the faultless functioning of their services or that they will be free from interruptions, disturbances or viruses.
8. Charges
8.1 Certain Comparis services are subject to charges. These paid services are labelled and the participant will be advised of the costs and valid charges prior to use of these services. Charges include VAT.
8.2 Charges are due for payment prior to the use of a paid service and can usually be paid by the user by credit card or telephone.
9. Copyrights/use of the website/ban on republishing
9.1 All information and content published by Comparis on the web are proprietary, are subject to the Comparis copyright and are entirely and exclusively the property of Comparis. Comparis explicitly reserves all rights in this regard. No rights regarding software or other elements of the content of the Internet address www.comparis.ch will be transferred to the participant by using, downloading or copying information. The same applies for the name Comparis, which is a registered trademark, and for labels and logos. The participant explicitly agrees neither to copy the content and information on offer, nor to publish it, nor to make it accessible in any form. Without exception, the participant must obtain agreement in writing from Comparis prior to any republication.
10. Final clause
10.1 Should individual terms of these conditions become ineffectual, this does not affect the effectuality of the remaining conditions. In such a case, the valid condition which is closest to the ineffectual condition in its economic consequences will apply.
10.2 In case of discrepancies between the various language versions of individual contracts, the German version applies.
10.3 These SBC are subject to Swiss law.
10.4 Place of jurisdiction is Zurich.
