Gross Negligence Protection

If you cause an accident because you failed to comply with traffic regulations due to gross negligence, the insurer may reclaim compensation (right of recourse).

Examples of grossly negligent offences are

  • driving over safety lines and stop signals,
  • passing through red lights,
  • speeding,
  • drinking and driving,
  • drug and medication abuse.

Some insurers will provide protection for gross negligence for slightly higher costs.

However, there is no insurance against drinking and driving, drug abuse or extreme speeding.

Several insurance companies do not offer explicit gross negligence protection, but determine for each case exactly how grossly negligent the driver's actions were.
This is usually determined by whether or not the driver's licence was confiscated by the authorities following the accident. Alcohol, drug abuse, extreme speeding, etc. are exceptions.
